FERC granted renewable energy resources an exemption from buyer-side mitigation rules in New York's installed capacity market.

NYISO can force idled generators to allow use of their interconnections for reliability purposes, FERC ruled last week, saying that such actions do not constitute an unconstitutional “taking” under the Fifth Amendment.

NYISO said a 2012 FERC order was unclear with respect to the comparison made between the default offer floor and unit net CONE in determining the floor.

NYISO asked FERC if a recent order meant to mitigate market power in the installed capacity market in New York City would apply to its new capacity zone in the Lower Hudson Valley.
